From what I’ve read and understanding I need to send a letter of going out of business ,does anyone know what all needs to be on the letter.? I too need to know all the specifics, but I think the most important part is notifying ATF that you intend to cease doing business and surrendering (or not renewing) your SOT. If I recall correctly, there are some boxes you check on the renewal form that will tell them you are not going to renew, I've not paid very close attention to them, but pulling up that form might give you a start. United Surplus Arms Posted October 29 Report Share Posted October 29 (edited) Letter should include the following and be on company letterhead (if you have it): 1. date, Name of business (FFL and EIN numbers), signature of responsible person, and a list of ALL post samples that you will be disposing of 2. Estimated date that you are giving up your SOT. All transfers must be approved prior to expiration of SOT. Normally a date 90 days in advance of your first submission for transfer 3. Attach the letter to each E-form 3 submission for the no-letter post samples. 4. I would date the letter the day you submit the first transfer (Eform 3). 5. if you are also giving up your FFL, then add that fact to the letter - and let your ATF POI know so they can send you the out of business paperwork 6. ATF seems to process these pretty quickly (a few days to a week or so) Here is an example: Nov 1, 2025 John Smith DBA Joe Blow Arms 123 Main St, Dayton Ohio 43320 937-321-1234 John Smith DBA Joe Blow Arms (FFL 1-23-45678) will give up their SOT (EIN 99-87654321) on Feb 1, 2026. All 3 post sample machine guns in my current inventory (listed below) will be transferred in accordance with 479.105 (f): 1. HK MP-5 9mm S/N 123456 2. HK 33 5.56mm S/N 654321 3.
