MP5 Posted April 2, 2023 Report Share Posted April 2, 2023 If a FFL/SOT (“Transferee”) had a machine gun that was originally transferred in from another FFL/SOT (“Transferor”) on a tax paid Form 4, how would that current registrant/Transferee transfer that MG out to another FFL/SOT? Would it just be done on a Form 3? Or ….. ???? And perhaps complicating the matter (?), the caliber box on the existing Form 4 is blank, as it came with three barrels of different calibers. Has anyone else had a situation like this? (Why the original FFL/SOT to FFL/SOT transfer was done via a tax paid Form 4 - almost 30 years ago - is a bit of a mystery.) Any info/input appreciated. mattnh Posted April 2, 2023 Report Share Posted April 2, 2023 (edited) Re: the “odd/mystery” original transfer long ago My guess is that the original F4 from the FFL/SOT was done on a F4 because the MG was held by him personally rather than in the inventory of the FFL (that would have allowed the item to transfer on a F3)…. It is also possible the original FFL/SOT didn’t know he could save 200 by using a F3 rather than a F4…. Also possible it was transferred by FFL after his sot had expired. @pstidan provided good advise above Send out on F3 and no changes using info on the F4. Is the form 4 in your name or the ffl? That's what will matter. Sole proprietor? If its yours and not in the business name, use a form 5 to get it into your inventory, then form 3 out. The "dba" business name of the partnership is in the "Trade Name" block 2b of the current Form 4 registration. (But does not appear in the "Transferee Name" Block 2a.)
