NOS USGI M781 shipping/ATF rule

Hi everyone, I've got a friend who wants to ship me some in the foil packaging M781 rounds. They are factory loaded NOS from years ago. I've bought many rounds new manufacture where they ship with blanks separate due to the 2019 (I think) ATF rule. Does anyone know if these can be shipped to me like regular ammo because removing the primers is not really doable. 

How do law enforcement agencies receive their M781's or other 40mm ammo? Do they also have to abide by the same practices of having them sent with primers removed?

Or is this a grey area?

Yes, I know there is a ton on-line stuff about this rule but wasn't sure if older rounds were grandfathered in.

It's a gray area. Someone asked the ATF about legality of them after nobody caring ever. ATF said, well technically they are explosive materiel because they aren't exempt as small arms ammo(debatable but whatever). No one has been charged, convicted, etc for chalk rounds. People still sell them on gunbroker live(not me). The manufacturers and dealers have switched to the primer-seperate sales which is what the ATF recommended to avoid legal issues. 

 

Police and military still buy them loaded and police carry 40mm Ammo around in pouches in their trunk, along with other real explosives(flashbangs) and such that aren't properly stored.

I don’t really want to open up the M212 holes to be able to install them in the field or drag out a tool to press them in. Not saying I am going to do it, but I wonder what the penalty would be if you were out in the middle or a desolate desert with a dozen or so and happened across the worlds most informed park ranger.
