SLT223
Hello all. I'm not the most knowledgeable on this subject. I have a prospective buyer for an MG I'm selling. He would like to make alterations to the gun while awaiting transfers to complete. Is it legal for me to send an MG to an 07/02 out of my state of residence and registration for gunsmithing work? This would also be the FFL/SOT who would handle the inbound transfer for the prospective buyer. If yes, is it legal for the 07/02 to come pick it up in my state prior to the F4 to the SOT being approved?
United Surplus Arms
you can transfer a MG to a gunsmith legally (out of state.) No paperwork is required (Form 5 NOT required) but I would recommend an invoice detailing the "transfer" and the work to be accomplished. The ATF is in agreement with this assessment. Have the gunsmith invoice the work done when they ship it back to you. They would have to ship it back to you prior to the F4 being approved. Technically, the person wanting the work done needs to complete a "Statement of Work" outlining exactly the work to be performed.

riflejunky
There was a dealer here in Georgia that ran into trouble for taking possession of a NFA item from out of state for the purpose of reselling said item prior to the form 4 being approved. Granted there were extenuating circumstances but he is in federal prison
